Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Condara website, applications, signals, market analysis, AI tools, and any related services (collectively, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract in your jurisdiction. You are solely responsible for complying with all laws and regulations applicable to you, including those governing the trading of financial instruments where you reside.

2. Nature of the Service

Condara provides market data, technical analysis, statistical models, AI-assisted insights, educational materials, and trading ideas ("Content"). The Service is provided for informational and educational purposes only. Condara does not provide personalised investment advice, financial advice, portfolio management, brokerage, custody, execution, or fiduciary services of any kind.

Condara is not a broker, exchange, investment fund, asset manager, or regulated financial advisor. We do not solicit, accept, route, or execute orders, and we never hold client funds.

3. Accounts and Subscriptions

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Paid subscriptions grant a limited, non-exclusive, non-transferable, revocable licence to access designated features for the duration of the active subscription period. Subscriptions may be cancelled at any time and will remain active until the end of the paid term.

4. Acceptable Use

You agree not to: (a) redistribute, resell, mirror, scrape, or republish Content without prior written consent; (b) reverse-engineer the Service or any algorithm; (c) use the Service to mislead, defraud, or manipulate markets; (d) circumvent any access control or rate limit; or (e) use the Service in any jurisdiction where doing so would violate local law.

5. User Responsibility

You acknowledge that all trading decisions you make are your own. You are responsible for conducting your own research, evaluating risk, sizing positions appropriately, and consulting an independent licensed professional where appropriate. You bear sole responsibility for any profits or losses resulting from your use of the Content.

6. No Warranties

The Service and Content are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability. Market data may be delayed, incomplete, or inaccurate.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Condara, its officers, employees, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, revenue, data, goodwill, trading losses, or business opportunity, arising from or related to your use of, or inability to use, the Service or Content — even if Condara has been advised of the possibility of such damages.

Where liability cannot lawfully be excluded, Condara's total aggregate liability for any claim shall not exceed the amount you paid to Condara for the Service in the twelve (12) months preceding the event giving rise to the claim, or USD 100, whichever is lower.

8. Indemnification

You agree to indemnify and hold harmless Condara and its affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party right.

9. Intellectual Property

All Content, branding, software, models, and trade marks remain the exclusive property of Condara or its licensors and are protected by intellectual-property laws.

10. Modifications

Condara may modify the Service or these Terms at any time. Material changes will be communicated through the Service or by email. Continued use after the effective date of a change constitutes acceptance.

11. Termination

We may suspend or terminate access at our discretion, including for breach of these Terms, fraud, abuse, or as required by law. You may terminate at any time by closing your account.

12. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where Condara is established, without regard to conflict-of-law principles. Disputes shall first be addressed through good-faith negotiation, and thereafter through the competent courts of that jurisdiction, unless mandatory consumer-protection law provides otherwise.

13. Entire Agreement

These Terms, together with the Privacy Policy, Risk Disclosure, Disclaimer, and AI Transparency Statement, constitute the entire agreement between you and Condara concerning the Service.

By using Condara you confirm that you have read, understood, and accepted these Terms in their entirety.
